General Terms and Conditions of the Website
These Terms and Conditions (hereinafter referred to as the "Agreement") constitute a legally binding electronic contract executed between Diving Secrets Company — Commercial Registration No. (1010749274) issued in Riyadh, Kingdom of Saudi Arabia, the company owning the registered trademark "Diving Secrets Center" (hereinafter referred to as the "Company" or the "Center") — and any person who uses, browses, registers on, or transacts through the Center's website (hereinafter referred to as the "User" or "Customer").
This Agreement enters into force upon the User's acceptance and commencement of registration, in accordance with the provisions of the Saudi Electronic Transactions Law and its implementing regulations. The User's use of the website — in any form whatsoever — constitutes acknowledgement that the User has read, understood, and unconditionally accepted all of its provisions.
Article 1: Preamble and Definitions
The preamble above, the Training Agreement, the Trip Agreement, the Equipment Sale Agreement, the Return and Exchange Policy, and the Privacy Policy form an integral and complementary part of this Agreement. The following terms shall have the meanings ascribed to them, unless the context requires otherwise:
- "Company": Diving Secrets Company, Commercial Registration No. (1010749274), the owner of all rights related to the "Diving Secrets Center" trademark, its branches in the Kingdom of Saudi Arabia, its website, and its mobile applications.
- "Center" or "Trademark": "Diving Secrets Center", the registered trademark owned by the Company under which all services are provided.
- "Website": The official electronic platform of the Center available at (divingsecrets.com.sa) and any official mobile application related thereto.
- "Services": Training courses, marine trips, sale of diving equipment, maintenance and rental services, and any other services offered by the Center.
- "Applicable Laws": Laws and regulations issued by the competent authorities in the Kingdom of Saudi Arabia, including — but not limited to — the E-Commerce Law, the Electronic Transactions Law, the Consumer Protection Law, the implementing regulations issued by the Saudi Federation for Marine Sports and Diving, and the training policies and guidelines for centers accredited by the PADI International Organization.
Article 2: Legal Capacity
- The User declares that they possess full legal capacity recognized under Sharia and applicable laws to enter into this Agreement, and that they are not less than eighteen (18) calendar years of age.
- Requests from persons under eighteen years of age are accepted exclusively through a guardian, who shall bear full legal and financial responsibility for the minor's transactions with the Center.
- The User shall bear full legal consequences in case of any breach of this article, and the Center shall be discharged from any responsibility toward third parties arising therefrom.
Article 3: User Accounts and Registration Obligations
- The User undertakes to provide accurate, true, current, and complete information upon registration, and to update it whenever changed.
- The User bears sole responsibility for maintaining the confidentiality of account credentials and for all activities carried out through the account.
- The User undertakes to immediately notify the Center of any unauthorized use of their account.
- The Center reserves the right to suspend or cancel a User's account upon proven submission of false information or breach of this Agreement.
- The User is prohibited from impersonating others or using credentials they do not have the right to use.
Article 4: Conditions for Using the Website
- The User undertakes to use the Website in accordance with public morals and the laws applicable in the Kingdom of Saudi Arabia.
- It is prohibited to use the Website or any of its services for unlawful purposes or in a manner contrary to public order.
- Any act that may harm the Website, its servers, or its databases is prohibited, including hacking attempts, unauthorized access, or distribution of malicious software.
Article 5: Electronic Communications
- The parties agree that all communications between them shall be conducted via the email address or phone number registered in the User's account.
- The User agrees that all electronic notifications shall replace their written counterparts and constitute independent legal evidence under the Saudi Electronic Transactions Law.
Article 6: Prices, Fees, and Tax
- All prices and fees are calculated in Saudi Riyals and include the legally applicable Value Added Tax.
- The User undertakes to settle all amounts due upon completion of the order through approved payment methods.
- The Center reserves the right to amend prices at any time, with new prices effective from the date of publication on the Website, without affecting orders already paid for.
Article 7: Payment Services
- The Website provides multiple payment methods through partners licensed by the Saudi Central Bank (SAMA).
- The Center issues a legally compliant tax invoice for every purchase.
- The User is responsible for verifying the accuracy of their financial data and card details before completing payment.
Article 8: Intellectual Property
All intellectual property rights related to the Website and the "Diving Secrets Center" trademark — including trademarks, trade names, logos, designs, graphics, texts, images, videos, interfaces, and software — are the exclusive and absolute property of Diving Secrets Company, and are protected under the Copyright Law and Trademark Law in force in the Kingdom of Saudi Arabia.
The User is prohibited from copying, reproducing, distributing, or commercially exploiting any part of the content without the prior written consent of the Company.
Article 9: Liability of the Center and Its Limits
- The Center undertakes to provide its services in accordance with applicable laws and the quality and safety standards approved by the PADI International Organization.
- The Center bears no liability for any direct or indirect damages arising from User errors or third-party actions such as shipping companies and payment service providers.
- The Center bears no liability for service interruption due to technical reasons, scheduled maintenance, or causes beyond its control.
- The Center's liability shall be limited — in all cases — to the value of the amount paid by the User for the disputed service.
Article 10: Confidentiality and Data Protection
- The Center adopts technical, organizational, and administrative protection standards in accordance with the Saudi Personal Data Protection Law.
- The User acknowledges that the Internet is not a fully secure medium, and that the Center cannot guarantee absolute data protection.
- The processing of personal data is governed by the approved Privacy Policy, which forms an integral part of this Agreement.
Article 11: Cancellation and Refund
All cancellation, exchange, and refund requests shall be subject to the provisions of the "Return and Exchange Policy" approved by the Center, which forms an integral part of this Agreement.
Article 12: Restriction of Access and Termination of Membership
The Center is entitled — at any time and without prior notice — to suspend a User's membership or restrict access to services in case of breach of this Agreement or applicable laws, without the User being entitled to claim any compensation.
Article 13: Governing Law and Dispute Resolution
This Agreement shall be governed by and interpreted in accordance with the laws applicable in the Kingdom of Saudi Arabia. The parties shall seek to resolve any dispute amicably; if not resolved within thirty (30) days from the date of written notice, jurisdiction shall lie with the competent courts in the city of Riyadh.
Article 14: General Provisions
- If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
- Arabic shall be the prevailing language for interpretation of this Agreement, and shall prevail in case of any discrepancy with the English version.
- The Center reserves the right to amend this Agreement at any time, with amendments effective upon publication on the Website.
