Trips Agreement

This Agreement is entered into between Diving Secrets Company — Commercial Registration No. (1010749274), the company owning the "Diving Secrets Center" trademark (hereinafter referred to as the "Company" or the "Center") — and the participant in marine diving trips organized by the Center (hereinafter referred to as the "Participant").

 

Article 1: Definitions

  • "Center": "Diving Secrets Center", the organizer of marine trips under the supervision of the Company.
  • "Trip": The marine diving or snorkeling trip organized by the Center, whether one-day or multi-day.
  • "Participant": Any person who registers in the trip and pays the subscription fee.
  • "Trip Leader": The person assigned by the Center to supervise the trip and ensure participant safety.

 

Article 2: Eligibility and Registration

  1. Participation requires reaching eighteen (18) calendar years of age; minors are registered through a guardian.
  2. The Participant undertakes to provide accurate information upon registration and bears full responsibility for any false information.
  3. Diving by the Participant requires a valid diving certification from an accredited international organization (PADI or equivalent), commensurate with the nature and depth of the trip.

 

Article 3: Participant Obligations

  1. The Participant undertakes to attend at the specified time and place, and is not entitled to claim any compensation in case of delay or absence.
  2. The Participant shall fully comply with the Trip Leader's instructions, marine safety regulations, and the implementing regulations of the Saudi Federation for Marine Sports and Diving.
  3. The Participant shall bring a valid identification document and valid diving certification, and submit a copy thereof to the Trip Leader upon request.
  4. The Participant bears full responsibility for personal belongings during the trip; the Center is not liable for their loss or damage.
  5. The Participant shall not conceal any health information that may affect their ability to safely participate in the trip.

 

Article 4: Prices and Payment

  1. The full subscription fee is paid in advance through the Website; prices include the Value Added Tax.
  2. The subscription fee includes — unless otherwise stated — marine transportation, Trip Leader services, and air tanks for specified dives.
  3. The subscription fee does not include — unless otherwise stated — personal equipment rental, insurance, or transportation to and from the trip port.

 

Article 5: Cancellation and Refund

All cancellation and refund requests related to marine trips shall be subject to the provisions of the "Return and Exchange Policy" approved by the Center, which forms an integral part of this Agreement.

 

Article 6: Trip Cancellation by the Center (Force Majeure)

The Center is entitled to cancel or postpone the trip without the Participant being entitled to claim any compensation — other than the refund of the paid subscription value pursuant to the Return and Exchange Policy — in any of the following force majeure cases:

  • Adverse weather or climatic conditions (storms, high waves, strong winds).
  • Natural disasters such as earthquakes, floods, and the like.
  • Inability to obtain required permits from competent authorities or revocation of issued permits.
  • Sudden malfunctions in marine transportation or essential equipment.
  • Any other reason beyond the Center's control that could not have been anticipated or avoided.

 

Article 7: Removal of Participant from the Trip

The Center is entitled to remove the Participant from the trip without refunding the subscription value in any of the following cases:

  • Breach of the Trip Leader's instructions or marine safety regulations.
  • Conduct contrary to public morals or offensive to other participants.
  • Use of any drugs or intoxicants before or during the trip.
  • Endangering self or others through reckless conduct.
  • Breach of applicable laws.

 

Article 8: Medical and Physical Disclaimer

  1. The Participant acknowledges that diving and marine activities involve physical risks that may extend to death, and that they participate voluntarily and assume all risks.
  2. The Participant shall consult a specialist physician before participation and ensure their health fitness.
  3. The Center, its instructors, and trip leaders are discharged from any civil or criminal liability for any physical or psychological injury or death, unless gross negligence by the Center is proven.
  4. The Participant bears full financial responsibility for any medical treatment or emergency transport required by their incident.

 

Article 9: Disclaimer Regarding Trip Outcomes

The Center does not guarantee specific outcomes from the trip (such as sighting specific marine creatures or reaching specific locations), as outcomes depend on natural factors beyond the Center's control.

 

Article 10: Final Provisions

  1. This Agreement is governed by the laws applicable in the Kingdom of Saudi Arabia, and judicial jurisdiction lies with the competent courts in the city of Riyadh.
  2. Arabic shall be the prevailing language for interpretation of this Agreement.
  3. The Center reserves the right to amend this Agreement at any time, with amendments effective upon publication on the Website.
