Diving Equipment Sale Agreement
This Agreement is entered into between Diving Secrets Company — Commercial Registration No. (1010749274), the company owning the "Diving Secrets Center" trademark (hereinafter referred to as the "Company" or the "Center") — and the customer who purchases diving equipment through the Website (hereinafter referred to as the "Customer").
Article 1: Definitions
- "Website": The official website of "Diving Secrets Center" (divingsecrets.com.sa) which displays and sells sports diving equipment.
- "Equipment": Sports diving equipment of all types offered for sale through the Website.
- "Customer": Any person who concludes a purchase contract with the Center through the Website.
- "Price": The published monetary value of the equipment, including Value Added Tax.
Article 2: Scope of the Agreement
The provisions of this Agreement apply to the sale of all sports diving equipment displayed on the Website and related services (such as shipping, installation, and warranty).
Article 3: Lawful Use
- Use of the Website is restricted to persons of full legal capacity (those who have reached eighteen years of age).
- Equipment for those under eighteen is purchased through the guardian.
- The Customer bears full responsibility for the confidentiality of account credentials.
- The Customer undertakes to provide accurate information and is prohibited from providing false information or impersonating others.
Article 4: Prices and Payment
- All prices are displayed in Saudi Riyals and include the Value Added Tax.
- The Center is entitled to amend prices at any time, effective from the date of publication, without affecting orders already paid for.
- The full price of equipment is paid upon completion of the order through approved payment methods.
- The Center issues a legally compliant tax invoice for every purchase.
Article 5: Delivery and Shipping
- The Center undertakes to deliver the equipment in its original condition and according to the published specifications.
- Shipping fees are calculated based on the delivery location and order size, and are added to the invoice value.
- The Center is not liable for delays caused by shipping companies or circumstances beyond its control.
- The Customer shall inspect the equipment upon receipt and notify the Center within twenty-four (24) hours of any damage or apparent defect.
Article 6: Intellectual Property
All intellectual property rights of the Website and the "Diving Secrets Center" trademark are the exclusive property of Diving Secrets Company, and are protected under the laws applicable in the Kingdom of Saudi Arabia.
Article 7: Refund and Exchange
All equipment refund and exchange requests shall be subject to the provisions of the "Return and Exchange Policy" approved by the Center, which forms an integral part of this Agreement.
Article 8: Warranty
- Diving equipment is subject to the warranty provided by the manufacturer, in accordance with the terms and duration published with each product.
- The warranty covers manufacturing defects only, and does not cover damages resulting from misuse, negligence, or accidents.
- The Customer shall retain the original purchase invoice and warranty card.
Article 9: Center Liability
- The Center undertakes to provide equipment matching the specifications published on the Website.
- The Center bears no liability for damages arising from the Customer's misuse of the equipment.
- The Center's liability shall be limited — in all cases — to the value of the disputed product.
Article 10: Final Provisions
- This Agreement is governed by the laws applicable in the Kingdom of Saudi Arabia, and judicial jurisdiction lies with the competent courts in the city of Riyadh.
- Arabic shall be the prevailing language for interpretation of this Agreement.
- The Center reserves the right to amend this Agreement at any time, with amendments effective upon publication on the Website.
